How proxy-buying treats brand IP, and how to file a takedown.
EFFECTIVE · 2026-05-30
VivyVeil LLC is a curated cross-border proxy-buying service for Asian alternative fashion. We do not design or manufacture garments. This Notice explains how we treat the intellectual property of the ateliers, designers, and brands whose pieces appear in our archive, and how rights-holders can request the removal of infringing content.
VivyVeil LLC operates an editorial archive. Every piece listed on the Site is sourced, on a customer's instruction, from the atelier, designer, or authorised reseller that produces it. We are not a brand. We are not an authorised dealer of any specific atelier unless we have said so on the Site in writing. We do not produce, modify, copy, replicate, "fan-make", or otherwise manufacture any garment.
Every piece is sourced directly from the original atelier, designer, or an authorised channel of theirs. We do not knowingly source or sell counterfeit, replica, or "factory copy" goods.
Our pre-shipment inspection checks: that the piece matches the order specification (atelier, name, size, colour, fabric), that the workmanship is consistent with the atelier's known production standard, and that the piece is visibly free of damage. Where we have any doubt about the authenticity of a piece received from a procurement channel, we return it to that channel and do not ship it to you.
Authenticity as a material deviation. An inauthentic piece — counterfeit, replica, or not from the atelier or authorised channel disclosed on the product page — is treated as a "material deviation" under the Refund Policy §12 definition. Where you receive a piece you believe to be inauthentic, contact us at legal@vivyveil.com within seven days of delivery with the order number and photographs (the same window and channel as the defective / wrong-item process at Refund Policy §6). We will investigate with the atelier and, where the doubt is confirmed, refund in full per Refund Policy §6 (including outbound shipping) and bear the cost of return; at your election we will instead source an authentic replacement at our cost.
If you are an atelier or rights-holder and you believe a piece sold through our archive is counterfeit or otherwise not from your authorised channels, contact us at legal@vivyveil.com. We will pause new orders for the piece pending investigation and remove the listing where the concern is substantiated.
Atelier names, brand names, garment names, collection names, and logos appear on the Site solely to identify the goods you are commissioning us to procure. This is nominative use: we use the brand name to refer to the brand, not to imply affiliation, endorsement, or authorised-dealer status.
Product photographs displayed on the Site fall into two categories:
If you are a rights-holder and you would prefer that a specific photograph not appear on the Site, contact us at legal@vivyveil.com with the URL and a statement of your rights, and we will remove it promptly.
Where a trademark owner believes that the way a mark is used on the Site causes confusion, suggests authorisation we do not have, or otherwise goes beyond nominative use, contact us at legal@vivyveil.com. We respond to legitimate trademark concerns within fourteen days.
VivyVeil LLC responds to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act, 17 U.S.C. §512(c).
To file a takedown notice, send the following to legal@vivyveil.com (subject: "DMCA Takedown Notice"):
We will remove or disable access to the material expeditiously and notify the affected user.
Counter-notice. If you are a user whose material has been removed and you believe the removal was a mistake or misidentification, you may submit a DMCA counter-notice under 17 U.S.C. §512(g) by sending the elements listed in the statute to legal@vivyveil.com (subject: "DMCA Counter-Notice"). After we forward the counter-notice to the original notifier, we will restore the material between the tenth and fourteenth business day, as required by 17 U.S.C. §512(g)(2)(C), unless the original notifier has filed a court action seeking to restrain the activity in the interim.
Designated agent. VivyVeil LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA, legal@vivyveil.com. The designated-agent registration with the US Copyright Office under 17 U.S.C. §512(c)(2) will be completed prior to first commercial publication of user-generated material.
The VivyVeil name and logo are our trademarks. The Site's design, layout, original photography, original copy, wing taxonomy, illustration, and source code are protected by applicable copyright and trademark law.
You may quote a short excerpt of our editorial copy or a single product image for personal, editorial, or news-reporting purposes with attribution and a link back. You may not republish the archive at scale, scrape our pricing, or use our copy or photographs to populate a competing service. See §6 of the Acceptable Use Policy (Site integrity) for the matching prohibitions on scraping, reverse-engineering, and bulk automated access.
Filing a DMCA notice that materially misrepresents the facts may give rise to liability under 17 U.S.C. §512(f). We may decline to act on notices that are facially defective or that we reasonably believe are made in bad faith (for example, attempts to use takedown processes to suppress legitimate nominative use of a brand name).
All authenticity, IP, trademark, DMCA, and rights questions: legal@vivyveil.com.
Customer-facing authenticity disputes — where you are the buyer and believe the piece you received is inauthentic — follow the Refund Policy §6 process (seven-day window from delivery, photographs, full-refund remedy) and route to legal@vivyveil.com for the substantive investigation and to support@vivyveil.com if you would prefer to start through the general support channel. The two queues forward to each other so the path you choose does not affect outcome.
