The agreement between you and VivyVeil.

These Terms of Service form a binding agreement between you and VivyVeil and govern your access to and use of vivyveil.com, our services, and any orders you place through us. By creating an account, placing an order, or otherwise using the Site, you accept these Terms.
The legal entity behind the Site is VivyVeil LLC, a limited-liability company formed under the laws of the State of Wyoming, USA, with its registered office at 30 N Gould St Ste N, Sheridan, WY 82801, USA.
VivyVeil ("VivyVeil", "we", "us", or "our") is the curated proxy-buying archive operated at vivyveil.com by VivyVeil LLC, with its registered office at 30 N Gould St Ste N, Sheridan, WY 82801, USA.
These Terms apply to all visitors, registered users, and customers. Separate policies referenced in §10, §6, and §15 — the Refund Policy, the Shipping & Customs Policy, and the Privacy Policy — form part of the agreement. Where any of those policies conflict with these Terms, the Terms prevail.
VivyVeil is a curated cross-border proxy-buying service. We do not hold inventory, we do not manufacture or design any garment displayed in our archive, and we are not a brand, atelier, or authorised dealer of any label listed on the Site.
When you place an order, you instruct us to procure the specified item from the relevant atelier, designer, or authorised reseller on your behalf and in your name. We coordinate sourcing, inspection, photography, and international dispatch.
We recognise that you contract with us, you pay us, and you look to us for confirmation, fulfilment, after-sales support, and refunds. We do not invoke the proxy-buying structure to deny direct responsibility to you for matters within our control. Where the consumer-protection law of your jurisdiction of residence treats VivyVeil as a seller, supplier, or trader vis-à-vis you, our obligations under that law apply in full and these Terms are read consistently with them.
Title to the goods passes from the atelier to you directly at the point the goods are tendered for international shipment. This allocation is for customs and importer-of-record purposes only and does not displace the consumer-law allocation above.
To place an order you must be at least the age of majority in your jurisdiction (eighteen in most jurisdictions). You agree to provide accurate registration and shipping information, to keep it up to date, and to keep your sign-in credentials confidential.
We may suspend or close an account at any time for material breach of these Terms, suspected fraud, repeated returns suggestive of wardrobing, or activity that exposes us, the atelier, or other customers to legal or operational risk.
The archive is organised into curated wings. Each piece is offered in one or more of three purchase modes:
Each piece's customer-facing price is the sum of an atelier price plus our transparent service fees (platform, order coordination, sourcing, and quality-inspection). The fee breakdown is shown on the product page for every piece priced under our current model.
The total due today at checkout is the in-mode amount only (full price for direct; deposit for deposit + balance; intent-deposit for wish). Shipping and any applicable sales tax are added in the modes and stages in which they are collected (see §6 and §7).
You may add pieces of multiple modes to a single basket. At checkout your basket is automatically split into one order per purchase mode, each with its own order number, its own payment, and its own fulfilment timeline. You will receive a confirmation email per order.
Order acceptance is at our discretion. We may decline or cancel an order, in whole or in part and at any time before dispatch, where the atelier turns out to have no stock, where pricing has materially changed at the atelier, where the order appears to be for resale, where we suspect fraud, or where we are otherwise unable to source the piece on commercially reasonable terms. In any such cancellation we will refund every amount you have paid in respect of the cancelled order, in full, to the original payment method (see the Refund Policy).
International shipping is by DHL, FedEx, or an equivalent tracked carrier. Shipping is collected in the order's own ship stage: now for direct, at the balance stage for deposit + balance, and at the balance stage for wish after conversion. Estimated shipping rates shown at checkout are calculated against the carrier's published rates for the destination and item weight; the rate actually paid is the rate quoted at dispatch.
You are the importer of record for every international shipment. Customs duties, import VAT or GST, and any handling or brokerage fee levied by the destination customs authority or carrier are your responsibility, payable to the relevant authority or carrier at or after delivery. We declare goods at their honest invoice value and never undervalue, mislabel, or undertake duty-evasion on a customer's behalf.
If a shipment is rejected at customs, returned to origin as undeliverable, or abandoned, refunds are handled under §7 of the Shipping & Customs Policy.
Where a single basket has been split into multiple orders, each order ships independently when it is ready. You may receive separate parcels arriving over weeks or months. Customs is assessed per parcel.
US destinations may be subject to sales tax based on the destination state's rate. When we are required to collect, the tax is added on the order's payment and itemised at checkout. International orders are exempt from US sales tax; recipient-side import duty and VAT/GST are as set out in §6.
Risk of loss passes to you on tender of the parcel to the carrier. For consumers, risk of loss passes only at the time required by applicable mandatory consumer law, including where such law provides that risk passes upon physical delivery to the consumer (notably Article 20 of EU Directive 2011/83/EU and section 29 of the UK Consumer Rights Act 2015). Where the mandatory rule applies and the parcel is lost or damaged before delivery to you, we will refund or replace at our cost.
Manufacturing defects, fit issues attributable to the atelier's published measurements, and similar product-quality matters are addressed under the atelier's own terms; the legal warrantor of product quality is the atelier or authorised reseller.
Our backstop where the atelier is unresponsive. We will mediate on your behalf in good faith. If, within sixty days of your initial written report to support@vivyveil.com, the atelier has not provided a remedy proportionate to the defect (refund, replacement, or repair as appropriate), we will at our own discretion and at our own cost step in to provide one of the following: (a) refund the affected piece in full to your original payment method; (b) source a replacement at no additional charge; or (c) credit your account for the price of the affected piece, useable on any future order. This backstop applies to confirmed product-quality defects that meet the definition of "material deviation" in §12 of the Refund Policy, is at our discretion as to which remedy applies, and is provided as a service commitment without admitting that VivyVeil is the legal warrantor of product quality.
Where the defect or error is attributable to us — lost in our care, mislabelled size, wrong item dispatched, or a quality issue we should have caught and disclosed before dispatch — we will refund or, at your election, source a replacement, without the sixty-day waiting period above.
If you are a consumer resident in the European Union or the United Kingdom, the Consumer Rights Directive 2011/83/EU (and its UK equivalent) gives you a right to withdraw from a contract for the purchase of goods within fourteen days from the day on which you, or a third party you indicated (other than the carrier), acquire physical possession of the goods.
The 14-day right of withdrawal applies to any goods purchased through us, except that deposit + balance and wish orders may be excluded from withdrawal rights where the item is made to your specifications, commissioned specifically for you, or otherwise falls within an applicable statutory exception (notably Article 16(c) of the Directive). Where no exception applies, your mandatory withdrawal rights remain unaffected. We will identify on the product page, before checkout, which deposit + balance and wish pieces are commissioned-to-order; if you have any doubt about whether a piece you have ordered is subject to withdrawal, contact us and we will treat the matter conservatively in your favour.
To withdraw within the 14-day window, send a clear statement of your decision to support@vivyveil.com before the window closes. We will refund the price of the goods and the cost of the cheapest standard outbound shipping option we offered. You bear the cost of returning the goods, as expressly permitted by the Directive. Returned goods must be in their original condition with tags attached. Refunds are processed within fourteen days of our receipt of the returned goods or of evidence that you have sent them back, whichever is earlier.
Per-mode refund rules outside the EU/UK 14-day window are set out in the Refund Policy, including: the 24-hour customer cancellation window for direct orders, the forfeiture of the deposit where the balance is not paid within fourteen days on deposit + balance orders, the full refund of wish intent-deposits where the wish fails through no fault of yours, and the final-sale treatment of wish intent-deposits where you voluntarily end the wish. The Refund Policy is incorporated by reference into these Terms.
You agree not to use the Site to:
We may suspend or cancel orders that we reasonably determine to violate this section. We may withhold a refund only to the extent permitted by applicable law and only to the extent reasonably necessary to recover losses, fees, chargeback costs, or other costs we have actually incurred as a direct result of the violation. Where an order has not yet been dispatched and we have not incurred unrecoverable costs, we will refund in full.
The brand names, atelier names, logos, garment names, and product photographs displayed on the Site reference the original makers solely for identification and editorial purposes. We claim no rights in any third-party trademark.
The VivyVeil name, the archive layout, original photography, original copy, code, and the curated wing taxonomy are owned by VivyVeil and are protected by applicable copyright and trademark law.
Rights-holders who believe their rights have been infringed on the Site may contact support@vivyveil.com with the URL, a description of the right, and a statement of authority; we will respond promptly and act on legitimate claims.
Your statutory consumer rights are not affected by this section. If you are a consumer, the laws of your country or state of residence may grant you non-waivable rights — to a product that conforms to its description, to a remedy for a defect, to a refund where a service is materially defective — and nothing in this section limits, excludes, or qualifies any of those rights. Where this section would conflict with such a non-waivable right, the right prevails for your purchase.
Subject to the paragraph above, and to the maximum extent permitted by applicable law where you are not a consumer or where the rights above do not reach, the Site and services are provided on an "as is" and "as available" basis. To that extent we disclaim all warranties not expressly granted in these Terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant uninterrupted or error-free operation of the Site.
To the maximum extent permitted by applicable law, in no event will VivyVeil or its affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to your use of the Site or any order will not exceed the greater of (a) the amount you paid to VivyVeil in the twelve months preceding the event giving rise to the claim, or (b) one hundred United States dollars (US$100).
Nothing in this section limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be lawfully limited. Nothing in this section limits your mandatory statutory consumer rights, including the right to a remedy for non-conformity, defect, or our material breach.
You agree to indemnify and hold harmless VivyVeil and its directors, officers, employees, and contractors from any third-party claim, liability, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.
You may terminate your account at any time by contacting us. We may terminate or suspend your access immediately, with or without notice, for any breach of these Terms. Sections that by their nature should survive termination (including §§8, 11–17, 19) survive.
We may amend these Terms from time to time.
Non-material changes (corrections of typos, clarifications, contact-information updates, and similar minor edits) take effect on posting; continued use of the Site after the effective date constitutes acceptance.
Material changes (changes that materially expand your obligations, materially reduce your rights, alter the governing law or venue, or change the refund or shipping-and-customs rules in a way that disadvantages you) will be posted on the Site and, where you have an account, emailed to you with no less than fourteen days' notice before the effective date. Continued use after the effective date constitutes acceptance, except: if you are a consumer resident in the European Union or the United Kingdom, or in any other jurisdiction whose consumer-contract law requires affirmative acceptance of material changes, we will present the change at your next sign-in and require your explicit acceptance before the new version applies to your existing account; until you accept, the prior version continues to govern your account and your existing open orders.
The version of the Terms applicable to a given order is the version in force at the moment that order was confirmed.
These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Wyoming have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction in those courts.
This section does not deprive a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection rules of any protection afforded by the law of their place of residence that cannot be derogated from by contract. If you are a consumer, you may also bring proceedings against us in the courts of your country of residence where mandatory law allows, and we may bring proceedings against you only in the courts of your country of residence where mandatory law so requires.
Lower-friction options for international consumers. Before turning to courts, you may at your option pursue any of the following lower-friction paths, and we will participate in good faith:
These options are offered without prejudice to your right to litigate in Wyoming under the rule above or in any court your mandatory consumer-protection law makes available to you, and they are without prejudice to our right to seek injunctive relief in any court of competent jurisdiction.
Mandatory consumer rights. Nothing in these Terms, the Refund Policy, or the Shipping & Customs Policy limits or excludes any mandatory consumer rights that apply in your country or state of residence. Where these policies conflict with mandatory consumer-protection law, the mandatory law prevails.
If any provision of these Terms is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Refund Policy, and Shipping & Customs Policy, form the entire agreement between you and VivyVeil regarding the Site.
